Tony is a senior partner with more than 45 years' experience in complex commercial agreements and disputes, particularly across intellectual property (IP), information technology (IT), life sciences, licence type arrangements and franchising. He has broad international experience, particularly in the USA, UK, Europe and Asia.

Tony's experience extends to advising about commercialisation of a broad range of technologies from start-ups to IPO/trade sales, including for drug development, medical devices, IT, and many others.

Tony's commercial experience includes taking companies overseas e.g. incl. USA, China, NZ, UK, and cases involving cross country jurisdiction & co-ordination, with an emphasis on technical and parallel issues. He has conducted many successful cases through to the High Court, and has been involved in more than 100 mediations.

Tony was the Deputy Chair for Australia and the Queensland Chairman of the IP Committee of the Law Council of Australia for over 20 years. He is also a member of various professional national and international organisations, including the American Bar Association, the International Bar Association, the American Intellectual Property Association, the International Distribution Institute based in Europe (the Australian correspondent), the International Franchise Association and presented at conferences and seminars nationally and internationally.

Experience

Konami Australia Pty Ltd and Konami Gaming Inc

Acting for Konami Australia Pty Ltd (KAP) and Konami Gaming Inc (KGI) against Aristocrat Technologies for infringement of various KAP & KGI patents relating to electronic gaming machines (EGMs), and acting for KAP in separate Federal Court proceedings brought by Aristocrat relating to EGMs known as the 'progressive linked jackpot' systems, and in defending the claim for account of profits and damages, which involved unique aspects previously undecided in Australian law, and which the Federal Court adopted successfully for KAP.

Fusetec 3D Pty Ltd

Acting for Fusetec in patent revocation proceedings against Dignity Health Inc and SurgiSTUD Inc in the Federal Court of Australia and defending Fusetec against a cross claim for patent infringement.

Microba Life Sciences Limited

Advising Microba on various capital raisings and its Initial Public Offering (IPO) and listing on the Australian Securities Exchange (ASX) and all related life science, Therapeutic Goods Association (TGA) and licensing/commercialisation related aspects.

Mickala Mining Maintenance Pty Ltd and Mickala Lighting Towers Pty Ltd

Acting for Mickala Mining Maintenance Pty Ltd (MMM) & Mickala Lighting Towers Pty Ltd (MLT) in defending claims of patent infringement by Southern Cross Pty Ltd (SX) and bring a cross claim in the Federal Court of Australia to have the SX patent declared invalid.

Advising these substantial franchisors across the residential home building, office fit outs and home renovation industries in all aspects related to intellectual property, commercialisation, structuring, financing and franchising across Australia, New Zealand, USA and Canada.

LT Game International Inc and LT Game International (Australia) Pty Ltd

Acting for LT Game in an international dispute over software gaming products under a Software Development and Licensing Agreement entered into in Australia with two Queensland based Plaintiff companies, RCD Holdings Ltd and ePayments Solutions Pty Ltd, for claims in excess of US$25 million, subject to the law of Macau. We successfully brought an application in the Qld Supreme Court to have the claims dismissed, and we recovered our client’s costs on an indemnity basis.
