Sam is an experienced litigator with a strong commercial focus.

His areas of expertise include insolvency litigation and advisory, security enforcement and asset tracing and recoveries.  Sam advises insolvency practitioners, secured lenders and creditors in the areas of distressed asset restructuring, asset realisations and cross border enforcement.  He is also involved in acting for directors and debtors in defending claims brought by liquidators, trustees and receivers, including purported breaches of the Corporations Act, breach of fiduciary duty and property related transfers or dealings.

Sam’s practise also extends to white collar crime and regulatory investigations with a focus on defending tax-related prosecution and enforcement matters. Sam also has a keen interest in advocacy and regularly appears in both the State and Federal Courts.

Sam has been recognised by his peers as one of the Best Lawyers in Australia in the area of Insolvency and Reorganization law (2019).

Recent experience includes:

  • Advising insolvency administrators, secured creditors and directors with respect to various complex issues arising from insolvency administrations  including in respect of South Australian Farmers Fuel Pty Ltd (Subject to Deed of Company Arrangement), EzyDVD Pty Ltd (In Liquidation) and Solar Shop Australia Pty Ltd (In Liquidation).
  • Acting for individuals and corporate entities across multiple jurisdictions internationally in actions brought by various law enforcement agencies concerning alleged tax evasion.
  • Advising a US private equity fund in relation to a major distressed debt investment and exit strategies in Australia.
  • Acting for creditors and accused parties in matters involving allegations of corporate fraud, dishonesty, misleading and deceptive conduct and market manipulation.
