In a recent decision, the Queensland Supreme Court settled any uncertainties surrounding the contractual requirement of a claimant to submit a statutory declaration as a condition precedent for a valid claim for payment under the Building and Construction Industry Payments Act 2004 (Qld) (BCIP Act). The judgment in BHW Solutions Pty Ltd v Altitude Constructions Pty Ltd [2012] QSC 214 provides a definitive statement in Queensland as to the purported contractual requirement for a statutory declaration to accompany a payment claim.
