Peter has more than 30 years’ experience in providing underwriting and claims management expertise to the insurance industry, acting for insurers, insurance brokers and self-insured entities in the heavy transport and car rental industries. 

Peter deals with all aspects of transport insurance, from front end policy writing and advice on underwriting and compliance issues, to indemnity and liability disputes.

His expertise includes advising on:

  • Insurance policy wording, compliance, and construction
  • Insurance indemnity disputes
  • Liability disputes in major torts and catastrophic claims
  • Marine and freight claims
  • Fire and mechanical defect claims
  • Claims for personal injury arising from public and product liability
  • Car rental agreements, including wording, compliance and construction, interpretation, and liability.

As an industry expert, Peter has an excellent rapport with the key participants and he recognises the importance of having claims dealt with quickly and efficiently prior to the issue of litigation. As a result, Peter consistently achieves significant savings in legal costs for his clients.

Recent experience includes:

  • Regular review and rewriting of heavy motor, liability, fleet, and marine freight insurance policies for a major national heavy transport insurer. This last review involved the creation of new policy benefits, the writing of a new Product Disclosure Statement, and a substantial restructure of the wording of the Dispute Resolution process. A further review, encompassing the recent amendments to the Insurance Contacts Act for unfair terms, is presently underway. 
  • Drafting the car rental agreement and terms and conditions used by a major international car rental company with ongoing advice regarding compliance issues, including ACCC and Australian Consumer Law requirements. The agreement and terms are in use throughout Australia and New Zealand.
  • Acted in two of Victoria’s major transport claims, the Burnley tunnel and Kerang rail collisions, and more recently, a substantial collision involving an ore locomotive at Port Hedland.
